ABOUT THE COUNTY CRIMINAL COURT OF APPEALS NO. 2
This court was established by the Texas Legislature in 1981 for the purpose of handling Class "C" misdemeanor* appeals from non-record municipal courts around Dallas county.
The majority of the Class "C" misdemeanor cases appealed were traffic tickets. Since the appeal was de novo**, the case was now going to be heard in a county criminal appeals court in downtown Dallas and this significantly reduced the likelihood of the municipal law enforcement officer appearing for trial on the case. Thousands of cases were appealed every year and thousands of cases were dismissed in this court.
Over the years most of the municipal courts became courts of record and the number of appeals significantly dropped to the point that by the late 1980s, this court was hearing so few appeals that it was decided that this court would become a regular county criminal court trying Class "A" and Class "B" misdemeanors*. Although this court retains the original name, it no longer handles appeals.
Judge Rosenfield is the third Judge to sit for the court and the only Democrat.
*Class "C" misdemeanors are criminal offenses that are punishable by fine only up to $500.00.
*Class "B" misdemeanors are criminal offenses that are punishable by up to 180 days in jail and up to a $2000.00 fine.
*Class "A" misdemeanors are criminal offenses that are punishable up to one year in jail and up to a $4000.00 fine.
**de novo means for the first time.
